Terms of service

This is the agreement between you and IT GUY IO LLC when you use Bandfolk. Please read it before creating an account. By creating an account you accept these terms.

1. Who you are contracting with

In these terms, "we" and "us" mean IT GUY IO LLC, and "you" means you as a user of the app.

2. What the service is

Bandfolk is an app where working musicians post short video clips of themselves playing, browse other musicians and match with each other in order to collaborate. Bandfolk is not a dating service and must not be used as one.

We introduce people to each other. We are not a party to any engagement, employment agreement or fee you agree with another user, and we do not guarantee that you will get work, matches or replies.

3. Who may use Bandfolk

  • You must be at least 18 years old.
  • You must be able to enter into a binding agreement.
  • You may hold one account only, in your own name or stage name.
  • You may not use the service if we have previously suspended you.

4. Your account

You are responsible for what happens through your account and for the accuracy of the information you provide. If you suspect someone else has access to it, contact support@it-guy.io straight away.

5. Subscription, payment and cancellation

Access to Bandfolk costs 99 SEK per month in Sweden. Outside Sweden the price is the one set for your country's storefront, and the App Store or Google Play shows it to you in your own currency before you buy. The subscription is ongoing and renews automatically every month until you cancel it.

  • The purchase is made in the app through the App Store or Google Play. Apple and Google respectively are the seller of record and handle payment, receipts and tax. We never take your payment directly and do not see your card details.
  • The charge is taken from the payment method attached to your App Store or Google Play account when the period renews.
  • Renewal is automatic unless you cancel at least 24 hours before the end of the current period.
  • How to cancel: on iPhone and iPad, go to Settings, tap your name, then Subscriptions, select Bandfolk and cancel. On Android, open Google Play, go to Payments and subscriptions, then Subscriptions, then Bandfolk. You can also start from the account settings in the app, which takes you to the same place.
  • Cancellation takes effect at the end of the current period. You keep your access until then, and we take no further payment after that.
  • Deleting your account does not end the subscription. Cancel it in the store first, otherwise the charges continue. See delete account and data.
  • Refunds are handled by Apple and Google under their own rules, not by us. If you get stuck, email support@it-guy.io anyway and we will help you as far as we can with the store.
  • If we change the price we will tell you in advance and you will be able to cancel before the new price applies.

If you are a consumer in the EU or EEA you may have a statutory right of withdrawal. Because the purchase is made with Apple or Google, their withdrawal and refund procedures apply to the transaction itself.

6. Your content

You keep every right you have in the clips, images and text you post. You grant us a non-exclusive, royalty-free, worldwide licence to store, encode, display and distribute that content within the service, to the extent needed to operate Bandfolk. The licence ends when you remove the content or delete your account, except for copies that remain briefly in backups.

By posting content you confirm that:

  • you have the right to post it, including rights in the music being played,
  • everyone else who appears or is heard in the clip has agreed to you posting it, and
  • the content does not breach section 7.

We do not use your content in marketing without asking you first, and we do not use it to train machine learning models.

7. Acceptable use and objectionable content

Bandfolk has zero tolerance for objectionable content and for abusive users. The following is prohibited:

  • Harassment, threats, bullying and stalking.
  • Hate speech and content attacking anyone on the basis of ethnicity, nationality, religion, sex, gender identity, sexual orientation, disability or age.
  • Sexual content, nudity and sexual advances.
  • Using the service for dating, romantic approaches or sexual solicitation.
  • Violence, incitement to violence, and graphic or shocking material.
  • Illegal content, illegal activity and any material that exploits children.
  • Impersonating anyone, posting someone else's recording as your own, or otherwise misrepresenting who you are or how you play.
  • Spam, chain messages, fraud, pyramid schemes and mass solicitation.
  • Collecting or spreading other users' data outside the service without their consent.
  • Trying to get around payment, scraping content automatically, or interfering with the operation of the service.

Reporting, blocking and what we do about it

Every profile and every clip can be reported directly in the app, and you can block a user so that the two of you no longer see each other. You can also email support@it-guy.io.

We review reports of objectionable content within 24 hours and remove content that breaks the rules. Whoever posted it can be suspended or have their account removed. Serious cases are referred to the authorities.

8. Suspension and termination by us

We can suspend or remove your account if you breach these terms, if it is necessary to protect other users, or if we are legally required to. We will tell you why where we can, and you can challenge the decision by emailing support@it-guy.io. If we close your account when you have not breached the terms, we will work through the subscription side with you and the store.

9. Availability and liability

We do what we can to keep the service working, but we cannot promise it is always available, free of faults, or that what other people put in their profiles is accurate. The service is provided as it is.

Our liability to you is limited to what mandatory law requires. We are not liable for work you did not get, for indirect loss, or for how other users behave outside the service. Nothing in these terms limits your statutory consumer rights, or our liability for intent or gross negligence.

10. Changes to these terms

We may update these terms. For material changes we will tell you in the app or by email a reasonable time before they take effect. If you keep using Bandfolk after that, you have accepted the new terms. If you would rather not, you can cancel your subscription and delete your account.

11. Governing law and disputes

These terms are governed by the law of the State of Wyoming, United States, without regard to its conflict of law rules. If you are a consumer resident in the EU or EEA, that choice of law does not apply to the extent it would deprive you of the protection of mandatory rules in your own country, and you can always bring proceedings before a court where you live.

If you have complained to us and are not satisfied, consumers in the EU can approach their national consumer advice service or a competent dispute resolution body in their own country.
